Our website is hosted using third-party technology and service providers, including Shopify, payment service providers and courier or logistics providers.
The availability of the website may occasionally be interrupted for maintenance, technical reasons, security updates or circumstances outside our control.
We do not guarantee that our website will be available without interruption at all times.
4. ELIGIBILITY TO PURCHASE
By placing an order, you confirm that:
-
You are legally capable of entering into a binding agreement;
-
The information supplied during checkout is accurate and complete;
-
You are authorised to use the payment method selected;
-
You have reviewed the product information before ordering; and
-
Where applicable, you have confirmed that the product is suitable for your vehicle.
TAL Rugged X reserves the right to refuse or cancel an order where reasonably necessary, subject to applicable law.
5. VEHICLE COMPATIBILITY
Many products sold by TAL Rugged X are designed for specific vehicles.
It is the customer's responsibility to ensure that the correct:
-
Vehicle manufacturer;
-
Model;
-
Model year;
-
Derivative;
-
Body configuration;
-
Engine configuration; and
-
Any other relevant vehicle information
is supplied or selected before placing an order.
For example, an accessory designed for one model year or derivative may not necessarily fit another derivative of the same vehicle.
Where you are uncertain about compatibility, you should contact TAL Rugged X before placing the order.
Providing your vehicle registration number, VIN, photographs or vehicle description does not automatically guarantee compatibility unless TAL Rugged X expressly confirms compatibility in writing.
Where TAL Rugged X incorrectly recommends or supplies a product after being provided with accurate vehicle information, the matter will be handled in accordance with applicable consumer law and our Returns, Refunds & Cancellation Policy.
Where a customer provides incorrect or incomplete vehicle information or selects the incorrect product, the customer may be responsible for return courier costs and any other legally permissible charges.
6. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions and compatibility information displayed on our website are accurate.
However:
-
Product colours may appear slightly different depending on the screen or device used;
-
Packaging may change without notice;
-
Manufacturers may update products or specifications;
-
Minor cosmetic differences may occur between production batches; and
-
Product photographs may occasionally include vehicles or accessories for illustration purposes that are not included in the purchase.
Customers should read the complete product description before ordering.
The contents of the package will be determined by the product listing and order confirmation and not solely by photographs.
7. AFTERMARKET PRODUCTS
Unless specifically stated otherwise, products offered by TAL Rugged X may be aftermarket products and are not necessarily manufactured, endorsed or supplied by the original vehicle manufacturer.
Vehicle manufacturer names, model names, trademarks and images may be used solely to identify compatibility with particular vehicles.
Where a product is represented as OEM, OEM-approved, genuine or manufacturer-approved, that description will only apply where TAL Rugged X has reasonable grounds for making such representation.
8. PRICING
All prices displayed on our website are quoted in South African Rand (ZAR) unless stated otherwise.
Prices may be changed from time to time without prior notice.
The price applicable to an order will generally be the price displayed and accepted at checkout when the order is placed, subject to obvious pricing errors and applicable law.
Courier charges, fitment charges and other additional charges will be displayed or communicated where applicable.
Where VAT applies, pricing will be treated in accordance with applicable South African tax requirements.
TAL Rugged X reserves the right to correct genuine pricing, typographical or technical errors.
Where an order is affected by an obvious error, we will contact the customer before proceeding where reasonably possible.
9. PAYMENT
Payment must be made using one of the payment methods offered during checkout or otherwise approved by TAL Rugged X.
An order will generally only be released, dispatched or booked for fitment once the required payment has been successfully received or confirmed.
TAL Rugged X may use third-party payment processors.
We do not independently control the banking or payment networks used by these providers.
Customers are responsible for ensuring that the payment information supplied is correct.
Where a payment is reversed, declined, disputed or identified as potentially fraudulent, we may suspend fulfilment of the order while the matter is investigated.
10. ORDER CONFIRMATION AND ACCEPTANCE
Submitting an order through our website constitutes an offer to purchase the selected products.
You will ordinarily receive an electronic confirmation after placing your order.
TAL Rugged X may verify:
-
Payment;
-
Product availability;
-
Vehicle compatibility where relevant;
-
Customer details;
-
Delivery information; and
-
Possible fraud or security concerns
before fulfilment.
If we are unable to supply a product that has been ordered and paid for, we will notify you and provide the appropriate refund or alternative options in accordance with applicable law.
11. STOCK AVAILABILITY
Products are sold subject to availability.
Although our inventory systems are regularly updated, circumstances may occasionally arise where a product becomes unavailable after an order has been placed.
This may occur because of:
-
Simultaneous online and offline sales;
-
Supplier stock changes;
-
Inventory errors;
-
Product discontinuation;
-
Damaged stock; or
-
Circumstances beyond our reasonable control.
Where a product is unavailable, TAL Rugged X will contact the customer regarding the available options.
We will not substitute a materially different product without the customer's agreement.
12. PRE-ORDERS AND SPECIAL ORDERS
Certain products may be sold as:
-
Pre-order items;
-
Special-order items;
-
Custom-manufactured products;
-
Imported-to-order products; or
-
Products specifically sourced for an individual customer.
Estimated lead times are estimates and may be affected by manufacturing, international shipping, customs, port delays, courier delays or other circumstances outside our direct control.
Custom-made, personalised and certain special-order products may have different cancellation and return rights where permitted by law.
Where possible, applicable special-order conditions will be communicated before or when the order is placed.
13. ORDER CANCELLATIONS
Customers should request cancellation as soon as possible.
Orders that have not yet been fulfilled, dispatched, specially procured or placed into production may generally be cancelled, subject to applicable law.
If an order has already been dispatched, it will normally need to be handled as a return once delivered.
Special-order, personalised or custom-manufactured products may not be cancellable once procurement or manufacturing has commenced where the law permits such restriction.
All cancellations remain subject to our Returns, Refunds & Cancellation Policy and applicable South African law.
14. RETURNS AND REFUNDS
Returns, exchanges and refunds are governed by the TAL Rugged X Returns, Refunds & Cancellation Policy.
Qualifying electronic transactions may carry statutory cooling-off rights.
Where applicable, such statutory rights take precedence over any inconsistent provision in these Terms.
For discretionary returns outside an applicable statutory cooling-off period, TAL Rugged X may charge a restocking and handling fee of up to 25% of the product purchase price where legally permissible.
Any such charge may take into consideration factors including:
-
Product condition;
-
Missing packaging;
-
Missing components;
-
Evidence of use or installation;
-
Cleaning;
-
Testing;
-
Repackaging;
-
Restoration; and
-
Reduction in resale value.
A 25% fee will not automatically be applied where doing so would conflict with a customer's statutory rights.
15. SHIPPING AND DELIVERY
TAL Rugged X offers delivery to qualifying locations using third-party courier and logistics providers.
Delivery estimates are provided in good faith but should not be interpreted as guaranteed delivery dates unless expressly agreed otherwise.
Delivery may be affected by:
-
Courier delays;
-
Weather;
-
Public holidays;
-
Strikes;
-
Road closures;
-
Remote delivery areas;
-
Incorrect delivery details;
-
Supplier delays;
-
Customs processes;
-
Force majeure events; or
-
Other circumstances outside our reasonable control.
Customers must provide an accurate physical delivery address and contact number.
TAL Rugged X will not be responsible for avoidable delivery delays caused by incorrect or incomplete delivery information supplied by the customer.
Any statutory rights relating to delivery remain unaffected.
16. INSPECTION ON DELIVERY
Customers should inspect delivered products as soon as reasonably possible.
If a parcel appears visibly damaged, customers are encouraged to photograph the packaging before opening it.
Where an item is damaged, incomplete or incorrectly supplied, please contact TAL Rugged X promptly and retain:
-
Product packaging;
-
Courier packaging;
-
Shipping labels;
-
Fittings and hardware; and
-
All supplied accessories.
Photographs or video may be requested to assist us in assessing the claim.
17. INSTALLATION AND FITMENT
Certain vehicle accessories require professional installation.
Where TAL Rugged X recommends professional installation, the customer should not attempt installation unless they possess the necessary knowledge, experience, equipment and technical information.
Products may require:
-
Drilling;
-
Cutting;
-
Wiring;
-
Electrical connections;
-
Programming;
-
Adhesive bonding;
-
Removal of vehicle components;
-
Adjustment;
-
Alignment; or
-
Other permanent modifications to the vehicle.
Customers must familiarise themselves with the installation requirements before proceeding.
18. DIY AND THIRD-PARTY INSTALLATION
Where an accessory is installed by the customer or an independent third party, TAL Rugged X is not responsible for loss or damage caused by incorrect installation, negligence or unauthorised modification.
Examples include damage resulting from:
-
Incorrect drilling;
-
Incorrect cutting;
-
Incorrect wiring;
-
Reverse polarity;
-
Short circuits;
-
Incorrect fuse selection;
-
Improper mounting;
-
Over-tightening;
-
Incorrect adhesive preparation;
-
Modification of brackets;
-
Modification of wiring harnesses;
-
Incorrect programming; or
-
Failure to follow installation instructions.
This provision does not exclude liability that cannot lawfully be excluded under South African law and does not remove statutory rights relating to a defect inherent in the product itself.
19. ELECTRICAL PRODUCTS AND WIRING
Electrical accessories must be installed correctly and in accordance with applicable instructions and vehicle requirements.
Customers should take particular care with products including:
-
Lighting;
-
Spotlights;
-
LED accessories;
-
Tow-bar wiring;
-
Plug-and-play harnesses;
-
Electronic modules;
-
Switches;
-
Controllers;
-
Adapters; and
-
Other electrical accessories.
TAL Rugged X cannot accept responsibility for electrical or vehicle damage caused by incorrect installation, alteration or connection of a product, except where liability cannot legally be excluded.
Any modification to a supplied plug-and-play harness may affect the product warranty.
20. TAL RUGGED X FITMENT SERVICES
Where TAL Rugged X performs installation or fitment, we will exercise reasonable care and skill in performing the service.
Customers must disclose relevant information about the vehicle before fitment, including any known:
-
Previous accident damage;
-
Body repairs;
-
Respraying;
-
Electrical modifications;
-
Aftermarket wiring;
-
Previous drilling;
-
Rust or corrosion;
-
Existing damage; or
-
Non-standard vehicle modifications.
Pre-existing defects or modifications may affect the fitment process.
Where an unforeseen vehicle-specific problem is discovered during installation, TAL Rugged X may contact the customer before proceeding with additional work.
The customer's statutory rights in respect of the quality of services remain unaffected.
21. PRODUCT WARRANTIES
Products may be covered by:
-
Statutory warranties;
-
Manufacturer warranties;
-
Supplier warranties; and/or
-
Additional warranties expressly provided by TAL Rugged X.
Warranty terms may differ between products.
Manufacturer or supplier warranty conditions do not replace statutory consumer rights.
Where a product is alleged to be defective, TAL Rugged X may reasonably inspect or test the product to determine the cause of failure.
Proof of purchase and information relating to the installation may be requested.
22. DEFECTIVE GOODS
Nothing in these Terms limits a qualifying consumer's rights under South African consumer legislation relating to defective, unsafe or poor-quality goods.
Where applicable, consumers may have statutory rights to a repair, replacement or refund.
Products will not ordinarily be considered defective where damage or failure results from circumstances occurring after supply, including:
-
Misuse;
-
Abuse;
-
Accident;
-
Incorrect installation;
-
Unauthorised alteration;
-
Modification contrary to instructions;
-
Improper maintenance; or
-
Normal wear and tear,
subject always to applicable law.
23. VEHICLE WARRANTY
The installation of an aftermarket accessory does not automatically mean that TAL Rugged X can determine how a particular vehicle manufacturer, importer, dealership or warranty administrator will treat an unrelated vehicle warranty claim.
Where maintaining a manufacturer warranty is important, customers should confirm applicable requirements with the vehicle manufacturer or authorised dealership before installing or modifying the vehicle.
Where TAL Rugged X expressly represents a specific accessory or installation method as approved for a particular vehicle warranty arrangement, that representation will apply according to its stated terms.
24. OFF-ROAD AND SPECIAL-USE ACCESSORIES
Certain accessories may be designed for off-road, recreational, aesthetic or specialised use.
The customer is responsible for ensuring that the use of an accessory complies with applicable road traffic, safety and vehicle regulations.
TAL Rugged X does not authorise the unlawful use of any product.
Where a product carries specific usage restrictions, customers must comply with those restrictions.
25. CUSTOMER-SUPPLIED PRODUCTS
Where TAL Rugged X agrees to install a product supplied by the customer, TAL Rugged X does not warrant the quality, durability, compatibility or condition of that customer-supplied product.
Any warranty relating to the product itself remains between the customer and the original seller or manufacturer.
TAL Rugged X remains responsible for the quality of any fitment service we perform to the extent required by applicable law.
26. PROMOTIONS AND DISCOUNTS
Promotional offers may be:
-
Time-limited;
-
Quantity-limited;
-
Limited to specified products;
-
Limited to specified customers or locations; or
-
Subject to additional promotional conditions.
Promotional offers cannot ordinarily be combined unless specifically stated.
Where a promotion states “while stocks last”, availability is limited to the relevant promotional stock.
TAL Rugged X reserves the right to correct genuine errors in promotional material, subject to applicable consumer law.

Where customers submit reviews, photographs, comments or other content to TAL Rugged X, they confirm that they have the right to submit that material.

31. FRAUD AND ABUSE
TAL Rugged X reserves the right to investigate orders that appear fraudulent, suspicious or abusive.
We may delay fulfilment while conducting reasonable verification.
We may refuse or cancel an order where there are reasonable grounds to suspect:
-
Fraud;

Unauthorised payment;

False customer information;
-
Misuse of promotional offers;
-
Resale fraud;

-
Limit statutory product liability rights;
-
Exclude a consumer's statutory warranty rights; or
-
Avoid any obligation imposed on TAL Rugged X by applicable South African law.
33. INDEMNITY
To the extent permitted by law, a customer who installs, modifies or uses a product contrary to supplied instructions or for an unlawful or unintended purpose accepts responsibility for loss or damage directly caused by that conduct.
This provision does not require a consumer to indemnify TAL Rugged X against liability that cannot lawfully be transferred or excluded.
34. FORCE MAJEURE
TAL Rugged X will not be liable for a delay or failure to perform an obligation where performance is prevented or materially affected by circumstances outside our reasonable control, subject to any rights the customer may have under applicable law.
Such circumstances may include:
-
Natural disasters;

-
Our products;
-
Business practices;
-
Website functionality;
-
Payment methods;
-
Applicable legislation; or
-
Regulatory requirements.
The version applicable to a transaction will generally be the version in effect when the relevant order is placed, subject to applicable law.
The current version will be published on our website.
36. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.
